ProgressMass not yet legally registered in Massachusetts

In January of 2012, a new non-profit, with the goals of establishing a Massachusetts Progressive infrastructure, was formed.  Their name is ProgressMass, and are listed as an affiliate of the ProgressNow network.  

ProgressNow was started in Colorado during the 2000s to help turn that state blue from red.  Their efforts were highlighted in the book The Blueprint: How the Democrats Won Colorado (and Why Republicans Everywhere Should Care).  They are an affiliate of the, convicted inside trader, George Soros' network of progressive organizations.

Since their inception ProgressMass has spent 99% of its time, and the resources of it's three full time employees, attacking Scott Brown through press releases, letters to the editor and on-line activism.  In an effort to look into their funding, Red Mass Group found out that they are not registered in Massachusetts as a Corporation as stated on their Terms of Service page yesterday.  The page has since been changed but an screenshot was archived.

In order to find out who is on the board of ProgressMass, a search was conducted on the Secretary of State's database of corporate registrations.  All 501(c)4 corporations are required to file with the Secretary of State in Massachusetts.  There is no record of a 501(c)4 corporation called ProgressMass on file.  This was confirmed by Brian McNiff the spokesman for William F. Galvin, the Secretary of State.

Last evening ProgressMass was asked to comment on the fact that they list themselves as a 501(c)4 non-profit, yet are not registered as such after close to six months of operation.  This morning they responded.

ProgressMass Executive Director Michael Fogleberg said, "ProgressMass is a non-profit start-up that was launched in January 2012.  As noted on ProgressMass' website, the organization is a state affiliate of ProgressNow, a non-profit, grassroots network of state-based organizations, and ProgressNow is currently operating as ProgressMass' fiscal agent.  ProgressMass has also filed for and received a tax identification number from the Internal Revenue Service."

Fogleberg continued, "ProgressMass staff is in the process of assembling a Board of Directors, a standard practice prior to filing as a 501c(4) corporation with the Massachusetts Secretary of State's office.  The page you referenced on the ProgressMass website should note that the staff is in the process of filing as a Massachusetts 501c(4) Corporation.  I thank you for pointing out the oversight, hope it hasn't been a source of confusion, and will correct the oversight accordingly.  Thank you for your inquiry."

One of the few areas that ProgressMass seems interested in, besides Scott Brown, is overturning Citizen's United.  In that spirit, ProgressMass was asked if they would be willing to release board members names.  Communications Director Mathew Helman responded, "Absolutely.  When we finalize our Board, the Board members list will be publicly posted on our website.  (Having just launched earlier this year, we're still in board-formation mode and haven't confirmed anyone yet.)"

Pam Wilmot, the Executive Director of the non-profit public watchdog group Common Cause Massachusetts, briefly spoke with Red Mass Group and said that she is looking into the situation, and may have more to say at a later time.

An organization fighting for transparency is lacking transparency in their own filings.  They complain about the lack of information available for voters, then fail to comply with disclosure.  Liberalism at it's finest!

They want to overturn Citizen's United, which protects the rights of corporations to do what ProgressMass would be doing, if they were doing it lawfully.  And, just guessing here, but do they routinely accuse others, including Senator Brown, of hypocrisy?

Should they be required to return all donations?
