Comments on the Ballot-Counting Procedure

I just received the following email, sent to the entire SC, from my friend and colleague Patricia Doherty, who represents the Second Middlesex district. I strongly urge everyone to read it carefully.

RECOLLECTIONS OF EVENTS LEADING UP TO AND DURING THE BALLOT COUNTING ON THE EVENING OF 1-31-13
Due to the fact that a number of people have been asking "who, what, when, where and why" concerning the events leading up to and during the second ballot counting, I believe it is necessary to set out the facts as I observed them.

At my request, the Chairman, Bob Maginn, asked two attorneys, one for each side, to accompany the second set of ballots into the counting room and remain in the room during the counting process, along with the appointed counters and a representative for each candidate.  

I made this request based upon the following facts:
1. During the tallying of the first ballots, the counters had refused to record a ballot marked "R.G."  for Rick Green.  At the podium, it was announced that Kirsten Hughes had won 39-38 with three abstentions.  After much heated discussion, the decision was made to accept the R. G. ballot in Rick Green's favor leading to a tie and therefore, another vote.

2. Brent Anderson and Matt Sisk attempted to stop the 2nd round of voting ;

3. Mr. Sisk's and Mr. Anderson's argument, that we should stop the vote and recount the first ballots, was predicated upon the contention that an un-named person had  "found" a ballot, previously thought to be blank, with the name Kirsten Hughes written on it;

4. The ballots from the first round, which should have been secured prior to the time that the counters and representatives left the counting room, were at some point unattended, leading to the Anderson/Sisk claim that a new Kirsten Hughes vote had been "found";

5. In fact, the ballots from the first round were eventually observed sitting in a bowl, of some sort, at the desk in front of the Chair and Vice Chair, rather than being kept securely  to insure the integrity of the voting process;

Based upon these concerns, Christine Cedrone and I were appointed by Chairman Maginn as the attorneys for the respective parties to accompany the ballots into the counting room, along with MA GOP Attorney Vincent  DeVito, Peter Torkildsen, Rep. Ryan Fattman and State Committeeman Matt Sisk.  Just prior to counting, National Committeeman Ron Kaufman joined us in the room.

Prior to the opening of the ballot box, I asked that the candidates be welcomed into the room at the end of the counting so that they may be told the result prior to the announcement from the podium. After a short discussion, Ron Kaufman agreed that this was an appropriate thing to do.

At the start of the counting, Attorney Vincent DeVito was asked if the ballots from the first round had been examined on both sides. Mr. DeVito responded, on two occasions, that they had, in fact, examined the ballots on both sides, "except for the first ballot". Rep. Fattman, who had been present throughout the first count, stated that Mr. DeVito's statement was simply not true. Rep. Fattman said that he saw the first ballot in the first round of balloting and that they had examined both sides.

During the counting of the second ballots, there were no contested ballots. Due to the close vote, it was not clear who had won until the end of the tally.  At that point, we agreed that the candidates would be called in before disclosing the results to the crowd. They were informed that the tally was 41-39 in favor of Kirsten Hughes, with no blanks. Rick Green congratulated Kirsten Hughes, as did others in the room. There was some discussion as to how the result should be announced.

Rick Green suggested that it was important for party unity that he and Kirsten proceed to the podium together and that he would announce the vote. Although there was some disagreement about this at first, Rick Green was adamant that we needed to ensure party unity. Kirsten Hughes agreed, as did the others present.
After a short delay, Rick Green and Kirsten Hughes went to the podium and Rick Green congratulated Kirsten Hughes on her victory.

WTF # 1
The MA-GOP looks like a 3rd World Banana Republic. Should the UN observers come in to monitor the election of the next Chairman? Don't give Jimmy Carter any ideas.

This is absolutely insane. Their are 80 lousy ballots. The should be counted in front of the everyone, in the same room, with votes being called out as they are counted.

WTF # 2
This one really blows my mind!

Although there was some disagreement about this at first, Rick Green was adamant that we needed to ensure party unity. Kirsten Hughes agreed, as did the others present.

Who on earth with person who objected or argued with Rick Green about him going out to announce Kirsten in the way he proposed?  The only thing I can think of is someone wanted to make him look like a sore loser.

When Maginn was elected Frank MacNamara gave a speech. There  is supposed be both a concession speech and an acceptance speech anyway. It it was too late for that. So it sounds like Rick was very gracious to Kirsten and was concerned about unifying the party. If he didn't do that, with all that had happened, people might have doubted the legitimacy of the vote.

Congratulations to both Rick and Kirsten.  

It sounds like it's time for DeVito to fired. He's given the MA-GOP  black eye more than once. And Brent Anderson doesn't exactly sound all too innocent in all this. He's the treasurer. That really should make us feel confident about how the accounting gets done.

This is the first I'm aware of you actually contributing to the narrative, and I have to say I appreciate your posting of this.

And now, may I join in saying WTF????????????????????  THIS is our GOP?  Good God, it's amazing they have gotten anything accomplished, albeit very little.  Could they start anew by firing DeVito forthwith?  As said by another poster, it's only a first start, but a start at that.

LOL....Now the entire State Committee knows what it's like to be a Ron Paul supporter. It looks like lies and election rigging is for you too. What's encouraging though, is the fact that nearly half of the State Committee members has smartened up!

The other half is divided between committed liberal infiltrators and the RINO fence-riders that crossed their fingers and voted the way they were told. To the latter I would remind that votes (like elections) have succinct consequences.  

So rather than run around saying "I told you so" I'll simply suggest that you all step back and soak in the stench of political deceit and shameless liberal appeasement. Hopefully you'll see what everyone else does and realize that you're killing what's left of the Party.

Those phonies that fell for Brown Inc.'s line of BS are solely responsible for destroying any chance we had of getting a Republican in the Senate AND may have caused a mass exodus from the Party that is unrecoverable.

The bag of excuses and weak rationalizations that won't pass the straight face test is empty. You sacrificed the Party for political gain and the hopes of a state job and everyone knows it.

Dave, I feel compelled to respond on behalf of those of my fellow SC members who do not deserve such derision and disdain.

I don't know everyone who voted, as I did, for Rick. I certainly don't know everyone who voted for Kirsten. Ultimately, however, if we're ever going to get anywhere, we're going to have accept that people are capable of having honest disagreements with each other.

Maybe some SC members were motivated as you suggest. I do know many on both sides who were driven by a sincere desire to move our party forward. I disagree, quite strenuously, with those who saw Kirsten as a choice preferable to Rick. The fact remains, however, that Kirsten was elected by a legitimate vote of the state committee. It was very close, yes. Again, I was very disappointed. But I intend to work with Kirsten, the rest of SC, and all activists to ensure that we elect as many Republicans as possible to positions in all levels of government in each and every one of the 351 cities and towns of our Commonwealth.

I haven't exactly been shy about voicing my discontent with those who argue for the usual way of doing things. I don't mean to discourage anyone else from doing so, either. But our party isn't divided into loyal Republicans and "liberal infiltrators and RINO fence-riders." None of us has a monopoly on the truth -- I most certainly don't (and I'm quite sure you find this a prime example!) I think it's time, though, that we all kept that in mind.

of what you said above, I would question what description was left off of this list:  "But our party isn't divided into loyal Republicans and "liberal infiltrators and RINO fence-riders." I would offer brain dead establishment that insist on repeating the unsuccessful ways of the past, or are there for the wrong reasons as a choice but wasn't sure how to succinctly label it, but it is good to identify what we are dealing with here.
