MassGOP State Committee Members Call for Special Meeting

I just received this email from State Committeeman Steve Aylward:

In accordance with our bylaws, 15 members of the State Committee have Requested that a Special Meeting be held to discuss the voting irregularities that occurred at our meeting of January 31, 2013.  The request was emailed to our secretary at approximately 12:05 AM on February 8th  2013.  A hard copy has been mailed to her today February 8, via Certified Mail - Return Receipt Requested. A copy was also sent to her by US MAIL, as well as to our Executive Director.  Our Secretary is also included on this email.

As a courtesy, I made sure to inform our new Chair last night that the meeting request was forthcoming.

The attached Word Document outlines some of the questions we would like answered.  The questions likely will give rise to perhaps other questions.

We are not questioning the character or integrity of any participant.  Our questions center on process and judgment, and a plan for the future.

Request Date February 8, 2013

The undersigned request a Special Meeting of the State Committee be called in keeping that the requirement set for in our by-laws.

The purpose of the meeting is to review the voting procedure for Chair as it took place at the State Committee meeting of January 31, 2013.  The requestor expect the following be accomplished:

• That explanation is given to the State Committee as to the criteria used to rule any ballot 'invalid', especialy in light of our policy that the ballot cast represents the intent of the voter.

• That explanation is given to the State Committee as to what employee of the State Committee determines that a vote is valid or invalid, and under which authority or rule said employee(s) make such a ruling.

• That explanation is given to the State Committee as to why two paid employees of the Massachusetts Republican Party, and a paid Consultant of the Party, whose future employment could possibly be dependent upon the outcome of the election, could be allowed to oversee said election.

• That explanation is given to the State Committee as to why notification of an invalid or spoiled ballot was not provided to the State Committee prior to any announcement of the result, and in doing so providing the State Committee people, the representatives of the people, the opportunity for a final decision on the spoiled ballot.

• That explanation is given to the State Committee as to why the roll call includes names of people not on the committee.

• That explanation is given to the State Committee as to the reason for the absence of our Parliamentarian.

• That the State Committee be provided with an explanation of who had control of the ballots from the first vote, after the results of the first ballot vote were officially announced.

• That explanation is given to the State Committee as to the markings, if any, on the two ballots counted as 'Abstain' in the first round of voting.

• That explanation is given to the State Committee as to how and when and by whom it was discovered that a ballot, or ballots,  from the first vote had a candidate name written on the back.

• That explanation is given to the State Committee as to when and by whom discovery of the ballot mentioned above was in fact reported to Mr. Brent Anderson, who used that information as a basis for his motion to re-count the first ballot.

• That explanation be given to the state Committee under which rules Mr. Scott Conway was also informed of the ballot mentioned above prior to all other State Committee members being informed.

• That explanation is given to the State Committee as to the procedures used to count and verify the ballots.

• That explanation is given to the State Committee as to why the ballots are removed from the room in which the voting took place.

• That the State Committee be provided with any other pertinent facts about this voting procedure which it deems pertinent.

• That the Chair, the General Counsel and all other participants in either of the two vote counts be prepared to answer questions from the State Committee members relative to the events of January 31, 2013.

• That any other further questions or concerns be answered regarding voting irregularities.

In order to facilitate the analysis, it is requested that all of the documents used at the time, including both sets of ballots, the ballot box, and any notes taken by any person involved in the vote count be available to the State Committee.  Additionally it is requested that any and all participants in the vote count, whether State Committee member or not, be invited to attend and answer questions at this Special State Committee meeting.

It is important to add that this call to meet  is based solely on concerns above process and judgment.   The concern is that meetings and voting going forward be conducted in a fair, professional and transparent manner, with full attention paid to decorum and procedure.   With our grassroots, the public and the media in full attendance, it is our duty to ensure that we as a committee always act and appear professional, and competent.

Any questions regarding the details put forth above can be directed to either Steven Aylward or Tim Sullivan of the State Committee.

Shouldn't that be former Chair?  Didn't Maginn preside over things?

Also, Maginn now being the former Chair probably can't be compelled to go to this meeting.  Right?

Since Maginn presided over the election, he should be available to answer questions. I don't think he needs to be compelled to show up. I think he'd come if asked.

Kirsten had nothing to do with whatever transpired. She should welcome this. In fact, if the debate over whether or not to count the ballot marked RG went on any longer, I would hope that she would stood up and insisted that it be counted.

I'm sure the last thing she wanted was to start her tenure with people doubting the legitimacy of her election. And that's precisely what would have happened if that ballot was not counted, or if the second vote did not proceed.

Bob Maginn was wise to rule the way he did. Now there is no doubt that Kirsten is the duly elected Chair.

So any attempt by anyone to portray this as attempt to question her legitimacy as Chair is nonsense.

Moreover, anyone that wants to paint this as sour-grapes is wrong.

We have a history of problems with certain individuals. Even Kirsten admitted during the debates that the caucuses were poorly handled and the provisional ballots should have been counted. All those problems and the issues from the 31st have the same individuals in common. So it would serve Kirsten and the party to clean this mess up rather than sweep it under the rug.

People abstaining and changing their vote isn't the problem.

The problem is the corruption displayed by those counting the ballots, first when they refused to count a ballot marked RG when the instructions were to discern the intent of the voter, second when they started looking and tampering with the first set of ballots while the 2nd vote was taking place, third when Mr DeVito lied about how the first set of ballots were examined.  

These are the issues. Not who decided to abstain, or who decided to vote for whom.  

Although Kirsten appears  not to be  connected or responsible for the apparent malfeasance, it all took place to benefit her. Therefore, she needs to be the strongest and loudest voice demanding an investigation.  She must conduct a purge of the sleaze which plagues the MA-GOP establishment, if she wants people to be assured that she represents the entire party and not just the King-makers and power-brokers.

John, very well put.  The argument is not with Kirsten's election as Chair,the second ballot unequivocally showed her as the new Chair.  The issue is with how the election was run and how the first ballot and the resulting should we count or should we not count 'RG' as Rick Green was handled.

The name that keeps coming up in the discussion of this issue and many other contentious issues over the last year, delegategate anyone, is Vincent DeVito, current General Counsel for MassGOP. Yes, the General Counsel by nature of their position, will be involved in most contentious issues, its sort of their job.  However, it appears that Mr. DeVito is not involved in solving these issues, rather he appears to be involved in their creation.

There is a great number of really good lawyers out there, even Republican lawyers.  It's time to make a change.  It's time for Ms. Hughes to make a step in rebuilding the confidence that activists and others had, but have lost, in the MassGOP.  Replacing Mr. DeVito as General Counsel at this meeting would be a welcome step and one which I would strongly encourage her to take.

(though I wondered if you meant sleaze in the plural?)

But another reason for Kirsten to come out strongest on this is that this represents only one facet of how the vote was 'attempted' to be manipulated.  Scott Brown's antics did little to help her become well seated from a position of strength as well.  YES, the time to show true leadership, and that she is not going to be more of the same, is NOW with decisive action against those that even appeared to corrupt the process.

During the race for Chair, there was much discussion about whether or not Kirsten would be independent or if she'd be under the control of Scott Brown, the good ole boys and the king-makers.

In her public statement Kirsten asserted that she was in this for the sake of the party and not the establishment.

Many of the State Committee people who supported her, stated the same thing.

Well this is a defining moment for Kirsten Hughes and those who voted for her.  If there is a thorough investigation, if the truth comes to light, if the session is open to public, if the process is fixed, if the problems (including the people that cause them) are eliminated, then we will know that Kirsten Hughes is in in fact her own person. We'll know she's serious about building and uniting the party.

Let there be no mistake, this isn't a witch-hunt. By the same token it's obvious there needs to be thorough house cleaning.

The MA-GOP is supposed to be the voice of reform. We cannot be that credible voice for reform in the Commonwealth, if our own house is NOT in order.

That said, we can walk and chew gum at the same time. Just because we are conducting internal house cleaning, doesn't mean we can't be working on getting Republicans elected and building our party. In deed this house cleaning will help us build the party because it will send signal to rank and file Republicans and Republican leaning independents that the MA-GOP is serious about reform.

That's where I had them. They laughed at me and made jokes, but I proved beyond the shadow of a doubt, and with geometric logic, that a missing vote did exist! And I'd have produced that missing vote if they hadn't ended the meeting! I-I-I know now they were only trying to protect Kirstin Hughes and!......

Naturally, I can only cover these things from memory if I've left anything out, why, just ask me specific questions and I'll be glad to answer them...one-by-one...
