Breaking: MassGOP Has 2PM Hearing

UPDATE- I just received a text message from Tarah Donoghue, the hearing has been rescheduled to 8am tomorrow morning.  The swearing in is currently scheduled for afternoon tomorrow, giving enough time for an injunction to take place.....  

The Massachusetts Republican Party has a 2PM emergency hearing before a Massachusetts court.  They have filed a request for an emergency injunction regarding the constitutionality of the appointment of Paul Kirk.  Developing...

If the Democrats can change the rules midstream and then insult us further by claiming the change was for emergency reasons then it is fine for the GOP to jump up and down a bit.  

Let's have our day in court and see if something can come from it.  Worst case scenario is nothing happens.

'Our day in court' is a waste of taxpayer money (we pay for the courts).  THAT is the worst case, my friend.

We didn't hae the votes to stop the bill.  We DID attract enough votes to prevent a LEGISLATIVE emergency preamble - making Patrick the sole authority on this.

We should hold him to that responsibility, and question his quisling judgement, not save him from it.

Becasue we WILL lose this fight, and look like cry-baby hypocrites in the process.

And every time we trivialize our ideas like this, every time we act like obstructionists, it makes more and more people discount us.

Can you remember the last time there was a press release or effort from MA GOP that wasn't a reaction to the Democrats instead of an ACTION of our own?

Would you be in court if the House vote had passed it?

Galvin has already released a list of Mitt's emergencies - boat speeds in Charlton, Moderator in Milton, etc.  Emergency in terms of legislation simply means it is time-sensitive, and the 90 day rule creates a hardship.

If it were called 'Expediting Preamble' (which is what it is) - would you still believe it was a constitutional issue?  Or are you taking grammar out of its context - legislative rules - to create a faux issue?

Use the situation as a constructive example to show why we need to elect more Reps. and Sens. - not play Daniel Webster at the SJC!

None of those had the emergency preamble in the bill.  The Dems mistake was they included the emergency preamble in the original legislation.  So they in effect voted it down.  It was not as is the custom added after passage.  

The Dems screwed up. We have a case.

The Referendum.
I. When Statutes shall take Effect.
No law passed by the general court shall take effect earlier than ninety
days after it has become a law, excepting laws declared to be
emergency laws and laws which may not be made the subject of a
referendum petition, as herein provided.
II. Emergency Measures.
A law declared to be an emergency law shall contain a preamble setting forth the facts constituting the emergency, and shall contain the statement that such law is necessary for the immediate preservation of the public peace, health, safety or convenience. [A separate vote shall be taken on the preamble by call of the yeas and nays, which shall be recorded, and unless the preamble is adopted by two-thirds of the members of each house voting thereon, the law shall not be an emergency law; but] if the governor, at any time before the election at which it is to be submitted to the people on referendum, files with the secretary of the commonwealth a statement declaring that in his opinion the immediate preservation of the public peace, health, safety or convenience requires that such law should take effect forthwith and that it is an emergency law and setting forth the facts constituting the emergency, then such law, if not previously suspended as hereinafter provided, shall take effect without suspension, or if such law has been so suspended such suspension shall thereupon terminate and such law shall thereupon take effect: but no grant of any franchise or amendment thereof, or renewal or extension thereof for more than one year shall be declared to be an emergency law. is a hearing a good thing or bad thing for the GOP and citizens of MA.?
To me it's GOOD*, but with an *.

We not only have to point out the actions of Democrats as hypocrites, but we must also show how FAR they will BEND the rules/constitution to do it.

WE/Conservative Republicans can show we did EVERYTHING against the whim of Democrat/hacks in back room deals and abuse of power. That we stood up for the citizens of MA. as best we could, we must then DROP it.

Then come election time, mix it with other examples of how the Democrats use citizens as sheep to do what EVER they want.
