"Bathroom Bill" - It's far worse than you think.

H. 1728: "An Act relative to gender based discrimination and hate crimes."  It has commonly been referred to as the "Bathroom Bill" for good reason.  The government is attempting to create a civil right to use bathrooms and places of exercise based on a gender expression independent from someone's actual gender based on biological fact.  However, this is not a bad provision in an otherwise positive bill.  The "Bathroom Bill" is far worse than you think.

It expands a 27 person permanent government commission.  "The commission shall be an independent agency of the commonwealth and shall not be subject to the control of any other department or agency."  The members are not elected, nor appointed by anyone who is elected.  They are appointed by a litany of left-wing special interest groups including Mass Equality and the Massachusetts Teachers Association.  This is not just a big government power grab, it grabs power and turns it over to left wing special interest groups that cannot be held accountable by we the people.

This panel will be charged with creating "programs supporting gay, and lesbian, bisexual and transgender youth on an ongoing basis to the department of education."  These new regulations and designed curriculum will not just apply to our local public schools.  This bill specifically outlines new regulations and restrictions on charter schools as well.

Section 24 specifically bans the the type of content that can be "published, issued, circulated, distributed or displayed, in any way, any advertisement, circular, folder, book, pamphlet, written or painted or printed notice or sign, of any kind or description" by private citizens in direct conflict of our first amendment rights.  To be clear:  I am not talking about government publications.  These are regulations on us as private citizens not employed by the government.  They want to ban what we can write in books.

These additional "rights" are really restrictions.  They restrict free enterprise, private business, and private citizens from running our businesses and living our lives the way we see fit.  Instead, we are put on the hook by trial lawyers for potential civil lawsuits and incur the inherent costs of compliance involved with any government regulation.

Don't like this bill?  Not in favor?  Too bad.  You are a hate filled bigot and the very title of the bill ends in "Hate Crimes."

Just say NO to the Bathroom Bill - H 1728! (5.00 / 1)
I was against the H 1728, the Bathroom Bill, back about 9-12 months ago when I joined other State Committee members, the staff of the Massachusetts Family Institute, and dozens upon dozens of social conservative activists to join in on the lobby day against the bill.

It was bad then & it's bad today.  The road to Hell is paved with the golden bricks of good intentions.

I was against it too, but until I actually read the full text of the bill (instead of just portions) I didn't fully appreciate how bad it was.  There is a lot more in this thing that I expected, like the blatant first amendment violations.

Since I have used bathrooms in Provincetown, where every trip is an advdnture in friend-making, I didn't think the world would end over transgender bathrooms.

THIS - a Star Chamber of the mind and free expression - is outrageous.

As you have connections in the campaign, can you ask Sen. Tisei, as a sponsor, to file an amendment to strip the 'publishing' panel section while leaving the balance intact?  Would he be willing to say that creating such unappointed and unaccountble control is improper and possibly illegal?

Yes, Richard Tisei co-sponsored the legislation.  This is an issue where I sincerely disagree with Richard Tisei.  

In fact, I was a State Committee member trying to rally my colleagues to visit his office and inform him personally of our objection to his sponsorship.  

Again, Tisei isn't perfect but he is good and he has my support for Lt. Governor as he certainly knew then & knows still now where I stand on this matter.

Richard Tisei was one of the first & most enthusiastic supporters of my district when I joined the State Commmittee.  Tisei personally asked for my support for his Lt. Gov. candidacy and I'm sorry if it bothers you but I will neither flip flop nor become a proverbial Judas, Brutus, or Benedict Arnold.

You may look at Richard Tisei & see the political equivalent of devil incarnate.  Me?  I see a gentleman, with as many flaws as any of us - perhaps just in other areas - who has been electorally successful for year after year, ballot after ballot doing his best to represent his district & serve the MassGOP Senate Caucus.

My favorite movie may be the Godfather but to quote Scarface's own Tony Montana, "I've got 2 things in this world, my word & my balls...and I don't break them for nobody."

You notice all the traction Cahill is suddenly getting?  Good Republicans are supporting him.  Why? It's not because of Charlie Baker.  It's because of Richard Tisei!

When folks from the Cahill campaign feel they can "reach out" to me on supporting Cahill, after all the, ahem....words....I've had for Loscocco, that should tell you something.

Cahills entire campaign will virtually screech to a halt if a Conservative is the GOP nominee for LG.  Tisei is dragging Baker down.  You know it, and so does everyone else.

A few days ago I commented on a post that the reason to pick Tisei was media-based.  In other words, there was a particular media outlet to which the Baker camp was trying to appeal (remember the same folks had Jane Swift Pat Guerrierro, the mini Tisei, a few years ago).

I guessed that it was an appeal to either a major tv station or print media.  Then, as if the very universe felt the need to make me feel good about myself, a post pops up on the Globe's glowing article of Baker/Tisei being able to tap Coakley voters (as if that's a good thing for the Mass GOP).

So there you have it, they had a plan with a calculated risk.  They figure if they lost 15% of Rs and pick up 10% of Ds, that nets them x number of votes.  

THey didn't count on losing 50% of Rs and probably some Ds.

Interesting that you did not choose to complete the quote because I think the omitted part is important to understanding where he may be coming from on this one. I have lived in the Senators district for 20 years and I must say that he does have a track record of treating everyone fairly.

...if I have any street cred with the "conservative community."  I'm not here to justify myself to you or "them."  Actually, considering the actions of many in that community, I wouldn't really want to be associated with some of the self-professed "pure" "true" & "real" conservatives.

Glad you posted this. It's definitely something everyone should be aware of, especially anyone considering electing an LG who sponsors this type of thing.  This makes me concerned for when my two year old daughter goes to pre-school or later when she attends elementary school and the things she will be taught.  It makes me concerned for the perversion and lewdness my girlfriend will endure when she goes to the gym after work. And it makes me concerned yet more for the continuing decline of decency in this Commonwealth and Country.

I agree that this bill is nonsense that opens the doors to pervs.....you assessment of Section 24 is....uhhh....lacking and pointed in the wrong direction.

It pertains to "place(s) of public
accommodation, resort or amusement" and you as an owner, lessee, or employee not being able to discriminate against the protected classes...the law Section 24 modifies is already on the books....Section 24 merely adds "gender identity or expression" to the protected classes.

Now, if you have a problem with THAT law.....GO AFTER THAT LAW....but good luck with the Supremes.

Beating back existing law is practically impossible.  Often times all that is left is preventing the slide down the slippery slope by fighting against the expansion of them.  So yeah, the Supremes would be a problem.

While on a break from work earlier this evening I happened to speak with someone from the Baker campaign.

In the interest of clarity lest there be some misunderstanding: I do not support the Bathroom Bill.  Likewise, Charlie Baker - Republican candidate for Governor - also DOES NOT support H 1728, the so-called Bathroom Bill.
