MassGOP lodges complaint on BBO General Counsel surrounding comments regarding Warren's Licensure

The Massachusetts Republican Party today filed a complaint with the Supreme Judicial Court regarding partisan statements made by Michael Frederickson the General Counsel for the Board of Bar Overseers.  Frederickson made comments which have blunted criticism of Warren practicing without a law license.  Comments he never should have made.  here is the press release from the MassGOP.

MassGOP Sends Letter To SJC Questioning Recent Comments By Michael Fredrickson That "Appear To Advance A Partisan Agenda"

Boston- Today, MassGOP Chairman Bob Maginn sent the following letter to the Honorable Chief Justice Roderick L. Ireland of the Supreme Judicial Court regarding recent comments made by Board of Bar Overseers General Counsel, Michael Fredrickson. The letter raises concerns about Mr. Fredrickson's public comments that "appear to advance a partisan agenda that is inconsistent with any agency within the judicial branch."

RE: Michael Fredrickson

Dear Chief Justice Ireland:

I am writing to express concern that the Board of Bar Overseers General Counsel Michael Fredrickson has made public comments without the benefit of any investigation or due process regarding legality of U.S. Senate candidate Elizabeth Warren's practice of law from her office in Cambridge without admission to the Massachusetts bar.  Mindful that Attorney Fredrickson has a fine reputation as General Counsel to the Board of Bar Overseers ("BBO"), a fictional writer, and law professor, I am nonetheless compelled to make your office aware of his recent public statements, as follows:

• "Michael Fredrickson, general counsel for the BBO, says he does not believe a law professor would be considered to have 'a continuous presence' or 'an office practicing law.'  'If they actually practice here - as some part-time law professors at some of the smaller schools do - they might,' Fredrickson says. 'But being a professor at one of the large schools, their office is a professor's office, and the fact that they tend to dabble in the practice of law doesn't run afoul of our rule. I don't think Elizabeth Warren would fall within that, such that she would have to register here.' (Lisa Keen, "Warren law license matter called non-issue," Mass Lawyers Weekly, 9/24/12).

•  "Fredrickson stated that he did not purport to determine whether Warren violated the applicable law.  He said he was just 'speaking hypothetically' and not specifically as to Warren because 'I know so little about Elizabeth Warren and her practice.'" • "Fredrickson confirmed that he did make the comments attributed to him in MLW, but also made clear that he was not speaking on behalf of the BBO.  Fredrickson said it was his 'personal reading' of the law, and that he was 'not speaking on behalf of the Board of Bar Overseers.'" Taking into consideration the honored tradition of the Supreme Judicial Court ("SJC") and the BBO with regard to not politicizing the carrying out of your respective responsibilities, Mr. Fredrickson's public comments appear to advance a partisan agenda that is inconsistent with any agency within the judicial branch. Foremost, Mr. Fredrickson's statements arrived in the public dialogue devoid of any formal investigation, fact finding, or proper evaluation.  Further, upon consultation with counsel, I understand Mr. Fredrickson's conclusions to be incorrect. As a threshold, the part-time practice of law is not any less the practice of law; and, without an appropriate exception to the Rules of Professional Conduct, a license is required for the practice of law in the Commonwealth. Lastly, while I notice Mr. Fredrickson's repackaged his statements as those of his own and not of the BBO they still may be attributable as opinions of the SJC and the BBO without a formal correction.

In view of the aforementioned, it may be appropriate for the SJC or the BBO to issue a statement recognizing the lack of authority and enforceability of Mr. Fredrickson's personal views. Accordingly, with this correspondence, I deferentially request that the SJC issue a statement or direct the BBO to issue a statement to that effect.

I expect Bob Maginn will get a response that says...... (0.00 / 0)
that the SJC will perform their own investigation into these statements sometime in December (after the election).  No doubt the investigation will show that there was 'nothing to see here folks'.  

We are headed for a 'Fiscal Cliff' and the country just elected a dope whose motto is 'Forward'.

It seems to me that the Mass GOP is shooting the messenger.  If the BBO attorney's onclusions are incorrect, has Maginn filed a complaint that Warren is practicing without a license?  Has anyone?

The BBO counsel should have clarified to the reporter that he was speaking as a citizen.  Once he did, the reporter should have reported it as such.  The same reporter in the same story omitted the fact that Lawrence Tribe is a contributor to Warren's campaign.  The SJC isn't going to weigh in on every media interview.

Is this the best investment of Chairman Maginn's time? God, I hope not.

Can you imagine explaining to some unemployed unenrolled person in central Massachusetts why the unofficial comments of some lawyer he has never heard of about an issue he is unlikely to understand are worth the time of the Republican party in the name of showing that Elizabeth Warren might have inappropriately helped with a legal case a long time ago?

No, I can't imagine that. Only partisan lunatics could.

You better do your homework. Warren has admitted handling cases (read practicing law) for the better part of her tenure at Harvard. Her name is on at least one brief that we know of. As a duly licensed attorney in Massachusetts, I can tell you the above topic has been a topic of concern for a number of attorneys, even on some bar blogs and most importantly, I am pretty peeved that she gets a free ride but when I went back to practicing law after several years home raising kids, I had to pony up well over $2000 to become active again. Upset? You better bet I am.

I have had multiple lawyers lay out to me that Elizabeth Warren committed a criminal act by practicing without a license in Massachusetts.  It is a misdemeanor, punishable in each instance by six months in jail.  How many clients times how many months?

GOP Sends Letter; Eno Calls It A Complaint (0.00 / 1)
Maginn is not a lawyer, therefore he has no standing with the Court or BBO.  The GOP CAN file a real complaint, using their General Counsel, that's a big deal  for the accusing attorney and they can get sanctioned for bringing a baseless, politically motivated complaint before the BBO.  Hence the reason why not formal complaint has been filed.  

Of course the State GOP feels they are entitled to use the SJC as a political prop, in an effort to distract voters with the degree in which Scott Brown disagrees with them.

Even if complaints have been filed with the BBO or AG by attorneys, it's unlikely that either the AG, DA or the BBO is going to release or comment on an investigation to the press or public.

Frankly, I think this should be a big head's up to all unlicensed law professors throughout MA and accounting professors with an out of state CPA.  Practicing attorneys and CPAs pay big $ for their license and are subject to oversight.  Warren et al, skate in and "dabble" (in this case dabbling is 6 figures but there you go) in their little ivory tower practice without any profession licensure oversight.

Seriously, can there be any doubt that she practiced law?

Quibble about Federal appearances, Supreme Court, the meaning of "practice law"...but what the F*** do you think she was doing in her office, at harvard working for private client for cash--practicing hairdressing?

Harvard Profs are different? The BBO's job is to protect the public and make sure the lawyers adhere to the rules of ethics.  Where was the oversight for Ms. Warren's law dabbling?

I'd be very surprised if there were no BBO or AG complaints already filed.

Hey, Malarkey, you are at it again. Are you so uninformed that you think a client could not go into file a complaint to the BBO alleging that his lawyer was practicing without a license? Boy, oh, boy, you guys will write anything.
Do you think that if Warren were on tv or radio and acknowedged that she were not a member of the Bar in MA and it comes to the attention of the BBO, that they do not have a duty to investigate?

Can the Chairman of the GOP please hire a proofreader who was an English major?

This is a stupid letter.

Releasing it in a press release (with the grammatical error) is a stupid move.

Filing a formal complaint with the BBO is the only means of guaranteeing this gets looked at.

Then they can come out with their "law professor's rule" to paper over it, and the profession will sink deeper into ill repute.
